The terms “Eziline Software House”, “us”, “we” or “our” refer to Eziline Software House, the owner of this website. The term “you” refers to the user or viewer of this website and the client of our services.
Acceptance of agreement
You agree to the terms and conditions outlined in this Terms of Use Agreement (“Agreement”) with respect to our site (the “Site”). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement.
This Agreement may be amended by us at any time without specific notice to you. The latest Agreement will be posted on the Site, and you should review it before using the Site.
Policies
All policies, rules and regulations are the final decision of Eziline Software House. We reserve the right to modify, add or change any policies as we deem necessary at any time. All members agree that they will not hold Eziline Software House liable for any items or policies within this program.
Refunds
Partial refund
We strive to keep our customers happy with every purchase. If you are not entirely happy with a particular service, we will issue a partial refund for that service. Refunds are issued only until the drafting stage of the website or software. Once the SRS or draft design is approved, or the website is launched, no refund is made.
Example. A customer pays hosting and domain fees, then pays for website design. We create a draft design or SRS document with a few designs. Cancelling at this stage returns 70% of the design payment. Hosting and domain fees are not refunded.
Refund of the initial amount
Our refund policy includes a refund of the initial amount if the client is not satisfied with the prototype demonstrated before we publish the design to HTML and start any programming.
We demonstrate our work on one of our links so you can review everything before making the complete payment and asking us to deliver the website on our server or any third-party hosting. Once you make the complete payment, the same copy of the website is delivered. A refund cannot be claimed after the website has been delivered. A website is considered delivered once it is posted on your hosting or ours, sent to you as a download link, or given to you on any storage media.
All domain and registration fees are non-refundable, in whole or in part, even if your domain registration is suspended, cancelled or transferred before the end of the current registration term.
Abuse & content
We do not tolerate abuse against Eziline Software House or its staff, whether by word of mouth, on the internet or anywhere else. If a customer spreads negativity or uses threatening, abusive or defamatory language towards us, we may cancel their order without further notice. We may also cancel an order or decline a refund if abusive or offensive language is used in communication with us.
The content, idea and theme of a website are provided by the client. Eziline Software House helps you conceive the idea. You agree not to post any material that is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of privacy, or otherwise in violation of any law.
Payment disputes & claims
Eziline Software House is a company with different divisions offering different services. If a client opens a claim or dispute against any of our services or websites, we may halt or cancel that client’s services in any division. We may also terminate any service in any division without further notice if a payment is due.
Design, images & revisions
48-hour turnaround
A draft design within 48 hours applies to working days only. Holidays and Sundays are not counted. This guarantee does not apply during natural calamities or accidental situations.
Image reseller rights
We use royalty-free graphics and images with a single-use licence, so they cannot be reused elsewhere. If you need images with reseller rights, please tell us before services begin so the correct licence is used. We use images from 123rf.com and bigstockphoto.com and follow their terms and conditions.
Unlimited revisions
Unlimited revisions are provided on the draft design only. No revisions are provided once the design is confirmed.
Free lifetime backups
We keep backups of all files and designs we create for our clients. We are not responsible for data lost due to malfunction of computers or storage devices, natural calamities or fire.
We reserve the right to refuse service to anyone, and may change these rules, regulations and policies at any time.
Payment terms
We accept 100% advance payment for projects under $500. Projects above $500 can be paid in parts. Please make sure you pay to the correct account. We are not responsible for any payment sent to a wrong account.
We accept PayPal, Pakistani banks and the other options listed on our Payment Details page. Please check the terms of use of your payment provider before making a payment.
Branding
An Eziline Software House logo and a line such as “This website designed, created, powered, hosted and maintained by Eziline Software House”, with an active link, is placed at the bottom of each page of the client’s website. Clients do not have the right to remove it. To remove it, please email info@eziline.com. Removal may cost an extra charge of around 30% of the software or website price.
If the credits are found removed from a website, Eziline Software House will cancel the free lifetime after-sales service and support contract and may take legal action.
Support & source files
Web application and software support
We provide support for a limited number of hours on our software and web applications. Additional hours are charged, because debugging, testing and creating new modules may be needed to keep a system stable.
Source files
We used to provide source files free of charge. Because other programmers and competitors have copied and resold the same scripts, Eziline Software House has the right to issue a separate invoice for source files. The price depends on the nature of the web application or software.
Testimonials
All testimonials and feedback on Google, Facebook or our website come from our clients, and are published only after they allow us to. We do not write any feedback ourselves.
E-commerce & security
Where a project involves e-commerce functionality, the client must ensure suitable arrangements are in place to maximise the security of financial and personal information of the project’s users. Eziline Software House has a strict policy of securing the confidential information submitted by clients during web design and development. However, Eziline Software House does not take responsibility for any leakage or misuse of information. So far, no claim or complaint has ever been submitted to us regarding this.
Completion date
Eziline Software House and the client work together to complete the project within the timescale defined in the specification. We keep the client informed of progress and always endeavour to meet the defined milestones.
The client must supply all source materials on time. Failure to provide source materials or respond within 30 days of the specified timescale is sufficient grounds for Eziline Software House to cancel the agreement and retain any deposits or stage payments made so far as cancellation fees.
Liability & backups
Limitation of liability
Eziline Software House will under no circumstances be liable for indirect, special or consequential damages, including any loss of business, revenue, profits or data, in relation to your use of the website.
When purchasing domain names on behalf of the client, Eziline Software House acts solely as the client’s agent and accepts no responsibility for the continuance of that registered domain name.
Backups and data loss
Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred, and to maintain appropriate backups of files and data stored on our servers.
We also provide backups and website maintenance for a small yearly charge. In this case cPanel and server details are kept with Eziline Software House and are not provided to the client at any stage, to protect the data. The client receives the admin panel or control panel, from which customisations are possible.
Cancellation
Eziline Software House and its hosting services reserve the right to cancel an account at any time.
If the client delays the start of work for more than 30 days after paying the deposit, Eziline Software House may add a surcharge to cover additional time and price increases since the original quote.
In the event of a dispute about the design of the website, or withheld or late payment, Eziline Software House may withhold or withdraw all web pages and image files until the dispute is resolved.
Eziline Software House may change any part of this agreement without notice, and your use of the website is deemed acceptance of it. We advise users to check these Terms and Conditions regularly. If any provision of this Agreement is held invalid or unenforceable, it will be struck out and the remaining provisions will remain in force.
